    On page 3, after line 32 of the amendment, insert the following:

    "A public facilities district may not impose the tax authorized in this section if, after the tax authorized in this section is imposed, the effective combined rate of state and local excise tax, including sales and use taxes on lodging, imposed on the sale of or charge made for furnishing of lodging in any jurisdiction in the public facilities district exceeds eleven and one-half percent."

EFFECT:  Prohibits the public facilities district from imposing the additional excise tax on lodging if the total combined excise and sales taxes on lodging exceeds 11.5 percent.
