Strike everything after the enacting clause and insert the following:
"Sec. 1. RCW 28A.160.210 and 1989 c 178 s 20 are each amended to read as follows:
(1) In addition
to other powers and duties, the state board of education shall adopt rules and
regulations governing the training and qualifications of school bus drivers.
Such rules and regulations shall be designed to insure that persons will not be
employed to operate school buses unless they possess such physical health and
driving skills as are necessary to safely operate school buses: PROVIDED, That
such rules and regulations shall insure that school bus drivers are provided a
due process hearing before any certification required by such rules and
regulations is ((cancelled)) canceled: PROVIDED FURTHER, That
such rules and regulations shall not conflict with the authority of the
department of licensing to license school bus drivers in accordance with
chapter 46.25 RCW. The state board of education may obtain a copy of the
driving record, as maintained by the department of licensing, for consideration
when evaluating a school bus driver's driving skills.
(2) School districts that have adopted a policy under section 2 of this act are exempt from the requirements for training type 2 drivers adopted under this section.
NEW SECTION. Sec. 2. A new section is added to chapter 28A.320 RCW to read as follows:
(1) Effective July 1, 1995, school district boards of directors may adopt a policy on what qualifications are necessary for school district employees, other than school bus drivers, to transport students to and from school-sponsored activities. Such policy shall require:
(a) A criminal background check under RCW 28A.400.303;
(b) A driver's license check that assures: (i) The applicant has not had a driving license privilege suspended or revoked within the preceding three years. A certified copy of the suspension or revocation order issued by the department of licensing shall serve as conclusive evidence of the suspension or revocation; and (ii) the applicant has not been involved in any crime within the preceding three years involving driving with a suspended or revoked driver's license, hit and run driving, driving while intoxicated, being in physical control of a motor vehicle while intoxicated, reckless driving, negligent driving of a serious nature, vehicular assault, or vehicular homicide; and
(c) An orientation on safety and emergency response.
(2) Any school district that has adopted a policy under subsection (1) of this section is exempt from the requirements for training type 2 drivers based on rules adopted under RCW 28A.160.210.
NEW SECTION. Sec. 3. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect July 1, 1995."
