     On page 4, line 26 of the amendment, after "project" insert ", except in those projects which have been previously submitted to the department prior to August 1994, under this act's predecessor legislation.  In such cases the department will accept the proposer who previously submitted a proposal in good faith under the terms and conditions of the predecessor's legislation:  PROVIDED, That the department, with the input of the legislative transportation committee and a public hearing, reviews the project's proposed costs and rates of return and finds them reasonable"
