    Strike everything after the enacting clause and insert the following:

 

    "NEW SECTION.  Sec. 1.  Some services of the state energy office are primarily advisory.  Some of its other services are essential and must be delivered by state government.  A small percentage of the state energy office budget consists of state general funds.  If the state energy office were to be closed without an orderly process that provides a planned transition, closing it could actually cost more than keeping it in its present form.  It is the intent of the legislature that the state continue to receive oil overcharge restitution funds for our citizens and that every effort be made to maximize federal funds available for energy conservation purposes.

 

    NEW SECTION.  Sec. 2.  By November 30, 1995, the department of community, trade, and economic development shall develop a plan for the future of the state energy office, including the possible closure or transfer of any duties of the state energy office to other governmental or nongovernmental entities.  The plan shall include any necessary proposed changes to state law.  The department shall present the plan in a report to the appropriate committees of the legislature and to the governor."
