    On page 6, after line 10, insert the following:

 

    "NEW SECTION.  Sec. 4.   A new section is added to chapter 84.36 RCW to read as follows:

    (1) The following property shall be exempt from ad valorem taxation:  Any and all pollution control equipment required by federal or state laws or regulations to be installed and used by a light and power business in the production of electrical energy to prevent or reduce air pollution or contamination that might otherwise result from the operation of a thermal electric generation facility placed in operation before July 1, 1995.

    (2) The ad valorem tax exemption provided under subsection (1) of this section shall apply for a period of thirty years, commencing with the date the property subject to the tax exemption under subsection (1) is installed onto the thermal generation facility.

    (3) For the purposes of this section, the value of the pollution control equipment shall be based upon the cost shown in the certificate required under section 2 of this act.

    (4) Claims for the exemption authorized by this section shall be filed with the county assessor on forms prescribed by the department and furnished by the assessor.  The assessor shall verify and approve such claims as he or she determines to be justified in accordance with this section."

 

    Renumber remaining sections consecutively and correct any internal references accordingly.
