On page 2, line 6, after "chapter." insert "The penalty for violation of section 2 of this act shall be a fine, payable to the general fund of the state, equal to three times the amount that was overpaid for travel."
On page 2, beginning on line 7, strike all of section 4 and insert the following:
"NEW SECTION. Sec. 4. A new section is added to chapter 42.23 RCW to read as follows:
Any officer or local government employee violating section 2 of this act shall be liable to the municipality of which he or she is an officer for a penalty equal to three times the amount that was overpaid for travel."

On page 1, line 3 of the title, after "42.52 RCW;" insert "adding a new section to chapter 42.23 RCW;"
Effect of amendment: Sets a standard for determining the lowest fare available, avoiding possible disputes arising from the availability of special fares obtained through wholesalers or other means. Fixes a maximum penalty for violation, both for state and local government officers and employees, removing the possibility of a mandatory forfeiture of office by local government officers. Clarifies that the penalty applies to local government employees as well as officers.

EFFECT: This merely clarifies that the section only applies to state personnel. Chapter 42.52 RCW does not apply to local government and this bill would create an ambiguity in this regard if the amendment is not adopted. The local government sanctions are already provided in section 4 of the bill.
