Background:  Cities and towns may adopt Washington State statutes and codes, regulations, and ordinances by reference.  A copy of the adopted statute, code, regulation, or ordinance must be filed in the office of the city clerk for use and examination by the public.

 

Code cities must also have a copy of the statute, code, regulation, or ordinance authenticated and recorded by the city clerk along with the adopting ordinance.

 

Summary of Bill:  The additional requirements of authentication and recording by the city clerk of any statute, code, regulation, or ordinance adopted by reference are deleted.

 

Appropriation:  None.

 

Fiscal Note:  Not requested.

 

Effective Date:  Ninety days after adjournment of session in which bill is passed.

 

Testimony For:  This will close a technical loophole for DUI defense lawyers. The city or town must still keep a copy of the statute, code, regulation, or ordinance available for public inspection.
