Background:  There is a basic adoption-by-reference statute for all cities and towns.  This statute requires that at least one copy of any code or statute which an ordinance proposes to adopt by reference be filed in the office of city or town clerk. 

 

The adoption-by-reference statute for code cities also requires that a copy of the code or statute adopted by reference be authenticated and recorded by the clerk along with the adopting ordinance.

 

Summary of Bill:  The additional requirements of authentication and recordation of the code or statute which the ordinance incorporates by reference, by the clerk along with the adopting ordinance are removed from the code cities' adoption-by-reference statute.

 

Appropriation:  None.

 

Fiscal Note:  Not requested.

 

Effective Date:  Ninety days after adjournment of session in which bill is passed.
