Title:  An act relating to district and municipal court service fees.

Background:  District and superior courts are given the authority by statute to collect fees for performing special services such as preparation of writs and transcripts.  The pertinent statutes set different fees for each court even though the same amount of time and preparation go into providing these services.

 

District court charges a fee of $6 for issuing a writ of garnishment, a fee of $12 for filing a supplemental proceeding and a fee of $6 for preparing a transcript of a judgment.

 

Summary of Bill:  The fee in district court for issuing a writ of garnishment is $20, the fee for filing a supplemental proceeding is $20, and the fee for preparing a transcript of a judgment is $15.

 

Municipal courts have the authority to charge similar service fees when applicable.

 

Appropriation:  None.

 

Fiscal Note:  Requested on February 8, 1995.

 

Effective Date:  Ninety days after adjournment of session in which bill is passed.
