Background: Under current law, retired teachers and administrators under Teachers' Retirement System Plan I may serve as a substitute for up to 75 days a school year without affecting their retirement benefits. If there is a shortage of substitute teachers, retired teachers or administrators can work an additional 15 days as substitute teachers.
Summary of Bill: A retired administrator under Plan I may serve as a replacement administrator for an additional 15 days without a reduction in retirement benefits, if the school district adopts a resolution declaring an emergency exists due to an unanticipated vacancy.
Appropriation: None.
Fiscal Note: Requested on February 27, 1995.
Effective Date: The bill contains an emergency clause and takes effect immediately.
Testimony For: When administrators leave before the end of a school year, it is better to bring in experienced replacements, and that replacement may be needed for longer than the time allowed by current law.

House Amendment(s): The intent section is deleted. The criteria to allow the additional 15 days is changed from "providing continuity in leadership" to "cannot find a replacement". The resolution adopted by the district, which allows the additional 15 days, is valid for only one school year. A retired administrator is limited to a total of 15 additional days per school year, whether they work as a substitute teacher, or as a substitute administrator.
