Prohibiting impaired persons from purchasing liquor.



    AN ACT Relating to prohibiting impaired persons from purchasing liquor; adding a new section to chapter 66.44 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 66.44 RCW to read as follows:

    (1) A person who is under the influence of liquor to the extent that the person is significantly impaired shall not purchase liquor.  For purposes of this section, a person is "significantly impaired" if the person has been denied within the previous twelve hours the purchase of liquor on the grounds that the sale would violate RCW 66.44.200, the person is sufficiently under the influence to present a danger to himself or herself or others, or the person is in danger of losing consciousness from further ingestion of liquor.

    (2) A violation of this section is a misdemeanor punishable by a fine of not more than five hundred dollars.

    (3) A defendant's intoxication may not be used as a defense in a prosecution under this section.

    (4) An establishment that sells liquor shall conspicuously post notice of the prohibition against the purchase of liquor that is provided for by this section.
