Prohibiting premium increase caps for long-term care insurance.



    AN ACT Relating to prohibiting premium increase  caps for long-term care insurance; amending RCW 48.84.030; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 48.84.030 and 1986 c 170 s 3 are each amended to read as follows:

    (1) The commissioner shall adopt rules requiring reasonable benefits in relation to the premium or price charged for long-term care policies and contracts which rules may include but are not limited to the establishment of minimum loss ratios.

    (2) In addition, the commissioner may adopt rules establishing standards for long-term care coverage benefit limitations, exclusions, exceptions, and reductions and for policy or contract renewability.  The commissioner shall not establish maximum levels of increases in the amount of the premium.

 

    NEW SECTION.  Sec. 2.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
