Specifying that it is not unlawful to take possession of a game animal killed by accident on a public highway, as long as it is not used as food for human beings.



    AN ACT Relating to game animals killed as a result of motor vehicle accidents; and adding a new section to chapter 77.16 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 77.16 RCW to read as follows:

    Nothing in this title or chapter restricts or prevents, or provides authorization for a rule restricting or preventing, any person from taking possession of, or using, any game animal killed by accident on a public highway, street, or road as a result of a collision with a motor vehicle.  This section applies only if the person taking possession has no intention of using the animal as food to be eaten by human beings and if no part of the animal is used as food eaten by human beings.

    Any person taking possession of the game animal from or next to a public highway, street, or road shall exercise due care in removing the game animal so as not to cause a motor vehicle accident.
