Prohibiting the resale and distribution of goods or services obtained by students under terms of a contract.



     AN ACT Relating to commercial activities by institutions of higher education; amending RCW 28B.63.050; adding new sections to chapter 28B.63 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     Sec. 1.  RCW 28B.63.050 and 1987 c 97 s 5 are each amended to read as follows:

     This chapter shall not apply to the initiation of or changes in academic or vocational programs of instruction in the institutions' regular, extension, evening, or continuing education programs, or the fees therefor, fees for services provided in the practicum aspects of instruction, or research programs, and in extracurricular or residential life programs, including residence halls, food services except as provided in section 2 of this act, athletic and recreational programs, and performing arts programs.

 

     NEW SECTION.  Sec. 2.  A new section is added to chapter 28B.63 RCW to read as follows:

     (1) All franchised or licensed food services provided in an institution and not operating on January 1, 1995, shall comply with RCW 28B.63.030 and 28B.63.040.

     (2) Franchised or licensed food services operating in an institution of higher education, on or before January 1, 1995, may continue in operation and are not subject to this section.

 

     NEW SECTION.  Sec. 3.  A new section is added to chapter 28B.63 RCW to read as follows:

     Institutions shall adopt policies prohibiting the resale or distribution of goods or services obtained by students under special terms of a contract to persons not authorized to buy or receive the goods or services under the terms of the contract.

 

     NEW SECTION.  Sec. 4.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
