Waiving certain licensing requirements so AFDC recipients can provide licensed day care in their homes.



    AN ACT Relating to child care provided by recipients of aid to families with dependent children; adding new sections to chapter 74.12 RCW; creating new sections; and providing a contingent expiration date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  Recipients of aid to families with dependent children may operate a licensed day care in their home under a partial exemption from licensing standards established under chapter 74.15 RCW.  The department of social and health services shall waive all licensing standards for recipients operating a child care program under this section, except standards relating to child safety.

 

    NEW SECTION.  Sec. 2.  Recipients of aid to families with dependent children who participate in the program in sections 1 through 5 of this act shall receive twenty-five dollars per week for each child cared for, up to a maximum of six children in care.  The department shall recruit volunteers to assist recipients with various aspects of providing child care.

 

    NEW SECTION.  Sec. 3.  The program in sections 1 through 5 of this act shall be limited to recipients of aid to families with dependent children.  Only recipients who require child care as a result of employment may participate in the program.

 

    NEW SECTION.  Sec. 4.  Income received by a recipient providing child care under the program in sections 1 through 5 of this act shall not be budgeted against the recipient's monthly grant payment.

 

    NEW SECTION.  Sec. 5.  The department of social and health services shall adopt rules under chapter 34.05 RCW to implement sections 1 through 4 of this act.

 

    NEW SECTION.  Sec. 6.   The governor and the department of social and health services shall seek all necessary exemptions and waivers from and amendments to federal statutes, rules, and regulations and shall report to the appropriate committees in the house of representatives and senate quarterly on the efforts to secure the federal changes to permit full implementation of this act at the earliest possible date.

 

    NEW SECTION.  Sec. 7.   In the event that the department of social and health services is not able to obtain the necessary exemptions, waivers, or amendments referred to in section 6 of this act before January 1, 1998, this act shall expire on that date and shall have no further force or effect.

 

    NEW SECTION.  Sec. 8.  Sections 1 through 5 of this act are each added to chapter 74.12 RCW.

 

    NEW SECTION.  Sec. 9.  If any part of this act is found to be in conflict with federal requirements that are a prescribed condition to the allocation of federal funds to the state, the conflicting part of this act is inoperative solely to the extent of the conflict and with respect to the agencies directly affected, and this finding does not affect the operation of the remainder of this act in its application to the agencies concerned.  The rules under this act shall meet federal requirements that are a necessary condition to the receipt of federal funds by the state.
