Stating the intent of the legislature that the powers of initiative and referendum apply to the growth management act.



    AN ACT Relating to powers of initiative and referendum regarding the growth management act; adding a new section to chapter 36.70A RCW; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  The Washington supreme court has concluded that the legislature intended to prohibit the exercise of referendum and initiative powers on actions taken pursuant to this chapter.  This act is necessary to clarify legislative intent.

 

    NEW SECTION.  Sec. 2.  A new section is added to chapter 36.70A RCW to read as follows:

    Nothing in this chapter is intended to prohibit the exercise of the powers of referendum and initiative reserved to the people of the state of Washington by Article II, section 1 of the Constitution of the state of Washington and the powers reserved to the people in counties in which the people have framed a home rule charter as provided in Article XI, section 4 of the Constitution of the state of Washington, in regard to any part of this chapter and any legislative actions taken pursuant to this chapter, except those actions which are expressly delegated in this chapter to the legislative authority of a city or county.
