AN ACT Relating to aeronautics; amending RCW 47.68.340; adding a new section to chapter 47.68 RCW; and repealing RCW 47.68.370.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 47.68 RCW to read as follows:
The aviation division is responsible for the conduct and management of all aerial search and rescue within the state. This includes search and rescue efforts involving aircraft and airships. The division is also responsible for search and rescue activities involving electronic emergency signaling devices such as emergency locater transmitters (ELT's) and emergency position indicating radio beacons (EPIRB's).
Sec. 2. RCW 47.68.340 and 1984 c 7 s 361 are each amended to read as follows:
A structure or obstacle
that obstructs the air space above ground or water level, when determined by
the department after a hearing to be a hazard or potential hazard to the safe
flight of aircraft, shall be plainly marked, illuminated, painted, lighted, or
designated in a manner to be approved in accordance with the general rules of
the department so that the structure or obstacle will be clearly visible to
airmen. In determining which structures or obstacles constitute ((or may
become)) a safety hazard, or a hazard to ((air))
flight, the department shall take into account ((only)) those obstacles
located at a river, lake, ((and)) or canyon crossing((s)),
and in other low-altitude flight paths usually traveled by aircraft including,
but not limited to, airport areas and runway departure and approach areas as
defined by federal air regulations.
NEW SECTION. Sec. 3. RCW 47.68.370 and 1984 c 7 s 363 & 1975-'76 2nd ex.s. c 73 s 1 are each repealed.
