Extending self-insurer workers' compensation coverage to contractors and subcontractors of self-insured employers.



    AN ACT Relating to extending self-insurer workers' compensation coverage to contractors and subcontractors of self-insured employers; and adding a new section to chapter 51.14 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 51.14 RCW to read as follows:

    (1) At the election of the self-insurer, the provisions of this section shall apply to any work or service performed under contract, whether by contractor, subcontractor, or both, for any person, firm, or corporation qualified as a self-insured employer under this chapter.

    (2) A self-insurer may fulfill its duty to secure payment of compensation under this title by extending its self-insurance certification to all contractors and subcontractors performing any work or services under contract for the self-insurer.  Such extension of self-insurance certification invokes all duties and obligations of the self-insurer as provided in this chapter.

    (3) For purposes of this section, all employees performing work or services for the self-insurer at the direction of the contractor or subcontractor employer shall be deemed employees of the self-insurer for workers' compensation coverage only and shall not be considered employees of the self-insurer for any other purpose.

    (4) The self-insurance certification and coverage extended under this section to employees of contractors and subcontractors under contract with the self-insurer shall be for the term of the contract and extend only to claims arising out of work or services performed under the contract.
