Restricting legislators' retirement benefits.



     AN ACT Relating to legislators' retirement benefits; adding a new section to chapter 2.10 RCW; adding a new section to chapter 2.12 RCW; adding new sections to chapter 41.26 RCW; adding new sections to chapter 41.32 RCW; adding new sections to chapter 41.40 RCW; adding a new section to chapter 43.43 RCW; and creating new sections.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  The legislature intends that its members not receive inflated retirement benefits resulting from salaries or wages earned in any other appointed or elected public office.  To achieve that end, each legislator's benefit shall be comprised of two separate retirement allowances:  One based on legislative service and the other based on nonlegislative service.

 

     NEW SECTION.  Sec. 2.  A new section is added to chapter 2.10 RCW to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and monthly salary in any state legislative position may only be used to calculate a separate retirement allowance under RCW 2.10.110 exclusively attributable to such service.  All other service and attributable monthly salary may only be used to calculate a separate retirement allowance under RCW 2.10.110 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 3.  A new section is added to chapter 2.12 RCW to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and monthly salary in any state legislative position may only be used to calculate a separate retirement allowance under RCW 2.12.030 exclusively attributable to such service.  All other service and attributable monthly salary may only be used to calculate a separate retirement allowance under RCW 2.12.030 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 4.  A new section is added to chapter 41.26 RCW under the subchapter heading "PLAN I" to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and earnable compensation in any state legislative position may only be used to calculate a separate retirement allowance under RCW 41.26.100 exclusively attributable to such service.  All other service and attributable basic salary may only be used to calculate a separate retirement allowance under RCW 41.26.100 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 5.  A new section is added to chapter 41.26 RCW under the subchapter heading "PLAN II" to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and basic salary in any state legislative position may only be used to calculate a separate retirement allowance under RCW 41.26.420 exclusively attributable to such service.  All other service and attributable basic salary may only be used to calculate a separate retirement allowance under RCW 41.26.420 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 6.  A new section is added to chapter 41.32 RCW under the subchapter heading "PLAN I" to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and earnable compensation in any state legislative position may only be used to calculate a separate retirement allowance under RCW 41.32.498 exclusively attributable to such service.  All other service and attributable earnable compensation may only be used to calculate a separate retirement allowance under RCW 41.32.498 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 7.  A new section is added to chapter 41.32 RCW under the subchapter heading "PLAN II" to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and earnable compensation in any state legislative position may only be used to calculate a separate retirement allowance under RCW 41.32.760 exclusively attributable to such service.  All other service and attributable earnable compensation may only be used to calculate a separate retirement allowance under RCW 41.40.185 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 8.  A new section is added to chapter 41.40 RCW under the subchapter heading "PLAN I" to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and compensation earnable in any state legislative position may only be used to calculate a separate retirement allowance under RCW 41.40.185 exclusively attributable to such service.  All other service and attributable compensation earnable may only be used to calculate a separate retirement allowance under RCW 41.40.185 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 9.  A new section is added to chapter 41.40 RCW under the subchapter heading "PLAN II" to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and compensation earnable in any state legislative position may only be used to calculate a separate retirement allowance under RCW 41.40.620 exclusively attributable to such service.  All other service and attributable compensation earnable may only be used to calculate a separate retirement allowance under RCW 41.40.620 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 10.  A new section is added to chapter 43.43 RCW  to read as follows:

     Except for the period of time that a member is on unpaid leave of absence for the purpose of serving as a state legislator, service and average monthly salary in any state legislative position may only be used to calculate a separate retirement allowance under RCW 43.43.260 exclusively attributable to such service.  All other service and attributable average monthly salary may only be used to calculate a separate retirement allowance under RCW 43.43.260 exclusively attributable to such nonlegislative service.

 

     NEW SECTION.  Sec. 11.  This act applies to all current and future members of the Washington state retirement systems.
