AN ACT Relating to Puget Sound shrimp licenses; adding a new section to chapter 75.30 RCW; and providing an effective date.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 75.30 RCW to read as follows:
(1) It is unlawful to commercially take any species of Puget Sound shrimp without obtaining a Puget Sound shrimp pot license or a Puget Sound shrimp trawl license.
(2)(a) A Puget Sound shrimp pot license may be issued only to an individual who held a 1995 Puget Sound shrimp pot experimental fishery permit.
(b) A Puget Sound shrimp pot license is fully transferable on a willing seller-willing buyer basis.
(c) A Puget Sound shrimp pot license is not subject to landing requirements.
(d) A holder of a Puget Sound shrimp pot license may designate only one alternate operator.
(3)(a) A Puget Sound shrimp trawl license may be issued only to an individual who held a 1995 Puget Sound shrimp trawl experimental fishery permit.
(b) A Puget Sound shrimp trawl license is fully transferable on a willing seller-willing buyer basis.
(c) A Puget Sound shrimp trawl license is not subject to landing requirements.
(d) A holder of a Puget Sound shrimp trawl license may designate only one alternate operator.
(4) The department may adopt rules to regulate fishing areas, gear types, seasons, and transferability of licenses as necessary to implement this section.
(5) This section takes effect January 1, 1997.
