Limiting the requirement of a utility to provide service to certain federal trust property.



     AN ACT Relating to provision of utility service to federal trust property; and amending RCW 80.28.110.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     Sec. 1.  RCW 80.28.110 and 1990 c 132 s 5 are each amended to read as follows:

     Every gas company, electrical company or water company, engaged in the sale and distribution of gas, electricity or water, shall, upon reasonable notice, furnish to all persons and corporations who may apply therefor and be reasonably entitled thereto, suitable facilities for furnishing and furnish all available gas, electricity and water as demanded, except that a water company shall not furnish water contrary to the provisions of water system plans approved under chapter 43.20 or 70.116 RCW.  However, a person or corporation may be denied service if the land on which such person or corporation is located is federal trust land which is covered by a settlement agreement between an Indian tribe and the state and local governments and the use of the land is not consistent with the provisions of the settlement agreement.
