Attempting to limit the spread of sexually transmitted disease.



     AN ACT Relating to preventing the spread of sexually transmitted disease through sexual intercourse; amending RCW 70.24.140; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     Sec. 1.  RCW 70.24.140 and 1988 c 206 s 917 are each amended to read as follows:

     It is unlawful for any person who has a sexually transmitted disease, ((except)) including HIV infection, when ((such)) the person knows or should know he or she is infected with such a disease ((and when such person has been informed that he or she may communicate the disease to another person through sexual intercourse)), to have sexual intercourse with any other person, unless ((such)) the other person has been informed by the person who has the sexually transmitted disease of the presence of the sexually transmitted disease.

 

     NEW SECTION.  Sec. 2.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
