Studying commercial real estate brokers' liens.



     AN ACT Relating to commercial real estate brokers' liens; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  The law and justice committee of the house of representatives shall study the issue of creating a commercial real estate brokers' lien.  The committee shall consider all relevant issues concerning whether it is appropriate to create a lien for commercial real estate brokers, and if so, the requirements and procedures that should be provided, including but not limited to:  The types of property and the types of transactions that should be subject to a commercial real estate brokers' lien; procedures for the filing or recording of the lien; procedures for the notification of persons with an interest in the property subject to the lien; rules regarding the attachment and priority of the liens; procedures for the termination of the lien; and procedures and time limits for the enforcement of the lien.  The committee shall report its findings to the legislature by December 31, 1996.
