AN ACT Relating to public disclosure of complaints filed under the uniform disciplinary act; amending RCW 18.130.080 and 42.17.310; and adding a new section to chapter 18.130 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION.  Sec. 1.  A new section is added to chapter 18.130 RCW to read as follows:

Written complaints submitted to a disciplining authority under this chapter are not subject to disclosure under chapter 42.17 RCW until the disciplining authority files a statement of charge or charges under RCW 18.130.090.  Reports of complaints for which statements of charges have not been filed are exempt from disclosure under chapter 42.17 RCW, but must be maintained in the records and tracking system of the department.

    Sec. 2.  RCW 18.130.080 and 1986 c 259 s 5 are each amended to read as follows:

A person, including but not limited to consumers, licensees, corporations, organizations, health care facilities, and state and local governmental agencies, may submit a written complaint to the disciplining authority charging a license holder or applicant with unprofessional conduct and specifying the grounds therefor.  All complaints must be in writing and signed by the person submitting the complaint.  A copy of the complaint shall be given to the license holder being charged by the disciplinary authority.  If the disciplining authority determines that the complaint merits investigation, or if the disciplining authority has reason to believe, without a formal complaint, that a license holder or applicant may have engaged in unprofessional conduct, the disciplining authority shall investigate to determine whether there has been unprofessional conduct.  However, investigations by the disciplinary authority must be related to matters pertaining to the complaint.  A person who files a complaint under this section in good faith is immune from suit in any civil action related to the filing or contents of the complaint.

    Sec. 3.  RCW 42.17.310 and 1995 c 267 s 6 are each amended to read as follows:
