Establishing commercial fishery license fee and renewal provisions for years with no fishing season.

    AN ACT Relating to commercial fishery licenses; and adding a new section to chapter 75.28 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 75.28 RCW to read as follows:

    If, for any reason, the department does not allow any fishing season during a license year, the department may either not collect the license fee for a commercial fishery license for that year or may allow the commercial fishery license fee that has been paid for that year to apply to a commercial fishery license for the next year.  The department may not refund license fees under this section.

    If a person with a commercial fishery license has not fished during a license year because the department did not allow any fishing season during the year, renewal of the person's commercial fishery license shall not be affected by such failure to fish.
