AN ACT Relating to state highway contracting; and adding a new chapter to Title 47 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. The purpose and intent of this chapter is to provide the maximum practical opportunity for employment, training, and diversity on state highway construction projects by establishing training requirements. By investing in and using registered apprentices on state highway construction projects, the legislature finds that the state can take a leadership role in creating new jobs to stimulate the state's economy, providing training to increase the skilled labor force across the state, and increasing diversity in the state's construction industry. It is also a primary objective of this chapter to train and upgrade minority and women workers toward journey level status, and to encourage their increased participation in the construction industry.
NEW SECTION. Sec. 2. The department shall establish training requirements on construction projects improving state-owned highway infrastructures that are funded with state tax revenues. The department shall use state-approved apprenticeship programs, as established by chapter 49.04 RCW, and presently operated by contractor associations, labor unions, and other organizations. The department shall adopt rules to establish and administer the training requirements.
NEW SECTION. Sec. 3. If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected. If any part of this act is found to be in conflict with federal requirements which are a prescribed condition to the allocation of federal funds to the state, the conflicting part of this act is hereby declared to be inoperative solely to the extent of the conflict, and such finding or determination shall not affect the operation of the remainder of this act in its application to the department. Contract specifications adopted by the department in compliance with this act must meet federal requirements that are a necessary condition to the receipt of federal funds by the state.
NEW SECTION. Sec. 4. Sections 1 through 3 of this act constitute a new chapter in Title 47 RCW.
