Authorizing retirement to care for a disabled spouse.



     AN ACT Relating to retirement in order to care for a disabled spouse; creating a new section; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A member of plan I of the public employee's retirement system who has at least twenty years of service and whose spouse has become severely and permanently incapacitated prior to the effective date of this act, may be retired under RCW 41.40.185, subject to the following conditions:

     (1) The member's spouse is mentally or physically incapacitated and the incapacity is likely to be permanent;

     (2) The member's spouse needs twenty-four hour, in-home care; and

     (3) The member's application for retirement is received prior to July 1, 1995.

 

     NEW SECTION.  Sec. 2.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
