Filing faxed documents.



    AN ACT Relating to the acceptance of faxed documents for filing with the secretary of state; and adding a new section to chapter 43.07 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 43.07 RCW to read as follows:

    (1) The secretary of state shall accept and file in his or her office electronic facsimile transmissions of any document required to be filed under Title 23B RCW or chapter 11.110, 18.100, 19.09, 19.77, 23.86, 23.90, 24.03, 24.06, 24.12, 24.20, 24.24, 24.28, 24.36, 25.10, or 25.15 RCW.  The acceptance by the secretary is conditional upon the document being legible and otherwise satisfying the requirements of state law or rules with respect to form and content.  The filing is effective as of the date of receipt by facsimile transmission.

    (2) If the original copy of a document must be signed and a copy of the document is filed by facsimile transmission under this section, the original copy shall be subsequently filed with the secretary.  The original copy shall be filed by a deadline established by the secretary by rule.  The secretary may by rule require that the original of any document, a copy of which is filed by facsimile transmission under this section, also be filed by a deadline established by the secretary by rule.  If the signature on the original does not match the signature on the facsimile, the acceptance of the facsimile under subsection (1) of this section is immediately revoked and the original shall not be accepted.

    (3) The secretary may provide by rule for the time and manner in which any filing fees may be paid if the filing is accomplished by facsimile transmission.
