Authorizing an alternate method for reducing city limits for cities with over fifty thousand population.



    AN ACT Relating to reduction of city limits; and amending RCW 35.16.010 and 36.93.105.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 35.16.010 and 1994 c 273 s 1 are each amended to read as follows:

    (1)(a) Upon the filing of a petition which is sufficient as determined by RCW 35A.01.040 requesting the exclusion from the boundaries of a city or town of an area described by metes and bounds or by reference to a recorded plat or government survey, signed by qualified voters of the city or town equal in number to not less than ten percent of the number of voters voting at the last general municipal election, the city or town legislative body shall submit the question to the voters.  As an alternate method, the legislative body of the city or town may by resolution submit a proposal to the voters for excluding such a described area from the boundaries of the city or town.

    (b) As an alternative to the procedures in (a) of this subsection, in a city with a population of over four hundred thousand, upon the filing of a petition which is sufficient as determined by RCW 35A.01.040 requesting the exclusion from the boundaries of the city of an area containing at least ten percent of the qualified voters of the city described by metes and bounds or by reference to a recorded plat or government survey, signed by qualified voters of the area proposed to be excluded equal in number to not less than twenty-five percent of the number of voters of the area proposed to be excluded voting at the last general municipal election, the city legislative body shall submit the issue of reduction of city limits to the voters of the area proposed to be excluded.

    (2) The question shall be submitted at the next general municipal election if one is to be held within one hundred eighty days or at a special election called for that purpose not less than ninety days nor more than one hundred eighty days after the certification of sufficiency of the petition or the passage of the resolution.  The petition or resolution shall set out and describe the territory to be excluded from the city or town, together with the boundaries of the city or town as it will exist after such change is made.

 

    Sec. 2.  RCW 36.93.105 and 1989 c 84 s 4 are each amended to read as follows:

    The following actions shall not be subject to potential review by a boundary review board:

    (1) Annexations of territory to a water or sewer district pursuant to RCW 36.94.410 through 36.94.440;

    (2) Revisions of city or town boundaries pursuant to RCW 35.21.790 or 35A.21.210;

    (3) Adjustments to city or town boundaries pursuant to RCW 35.13.340; ((and))

    (4) Adjustments to city and town boundaries pursuant to RCW 35.13.300 through 35.13.330; and

    (5) Reductions in city boundaries pursuant to RCW 35.16.010(1)(b).
