Providing
minimum retirement benefits.
AN ACT Relating to
minimum retirement benefits; amending RCW 43.43.277; and creating a new
section.
BE IT ENACTED BY THE LEGISLATURE
OF THE STATE OF WASHINGTON:
Sec. 1. RCW 43.43.277 and 1987 c
173 s 2 are each amended to read as follows:
(1) The benefits
provided under subsection (2) of this section shall be available only to
surviving spouses whose allowances commenced before January 1, 1970, and who
are not receiving and are not eligible for federal old age, survivors, or
disability benefits.
(2) Effective July 1,
1987, the minimum retirement benefit provided pursuant to RCW 43.43.275(1) to
surviving spouses who meet the qualifications in subsection (1) of this section
shall be twenty-three dollars per month per year of service. However, the
minimum benefit for the surviving spouse of a member who died in service who
meets the qualifications in subsection (1) of this section shall be calculated
using twenty years of service or the member's actual years of service,
whichever is greater.
(3) Effective July
1, 1996, the minimum benefit under RCW 43.43.260 and 43.43.270(1) for the
member or RCW 43.43.275(1) for the surviving spouse shall not be less than five
hundred dollars per month if the member has completed at least twenty-five
years of service in this system.
NEW SECTION. Sec.
2. The joint committee on
pension policy shall study the benefits provided to surviving spouses of
retirees of the Washington state patrol retirement system and shall report to
the fiscal committees of the legislature by January 1997.
