HB 1026 - DIGEST
Prohibits the regulation of private property or a restraint of land use by a governmental entity unless an analysis of the total economic impact is prepared and made available to the public at least thirty days prior to adoption of the regulation.
Requires the adoption of a regulation or restraint that has the least possible impact on private property and still accomplishes the public purpose.
Establishes guidelines for determining when private property shall be considered to have been taken.
Requires a landowner to be given full compensation for the reduction in value of the regulated property.
Authorizes enforcement of the act in Superior Court with payment of prevailing plaintiff's fees and costs.
