HB 2161 - DIGEST

     Provides that a person convicted of the manufacture, delivery, or possession with intent to manufacture or deliver a controlled substance shall be sentenced to life imprisonment without possibility of release or parole.

     Declares that the sentence shall be death if, pursuant to a special sentencing proceeding, the trier of facts finds that there are not sufficient mitigating circumstances to merit leniency.
