HB 2918 - DIGEST

 

     Creates a supervisory committee within the court of appeals, consisting of three judges, for the purpose of selecting an independent counsel for the investigation and prosecution of persons specified in this act.

     Provides that an elected official of the executive branch, and a director or deputy director of a state agency, are subject to preliminary investigation by the attorney general and appointment of an independent counsel by the supervisory committee of the court of appeals for the investigation and prosecution of violations of criminal law.

     Directs the attorney general to apply to the supervisory committee for the appointment of an independent counsel if:  (1) The attorney general determines after completion of the preliminary investigation that there are reasonable grounds to believe that further investigation is warranted; or

     (2) the ninety-day time period for conducting the preliminary investigation and any time extension granted have elapsed and the attorney general has not filed a notification with the supervisory committee.

     Designated the procedures for appointment of the independent counsel and details the duties of the counsel.
