     On page 1, line 9, strike "No" and insert "Except as provided for in subsection (6) of this section, no"

     On page 1, line 13, after "delivers a" strike everything through "delivery." on line 14 and insert "viable fetus repositioned into a breach position and terminates the life of the fetus by introducing an instrument or device into the cranium of the fetus."

     On page 2, line 10, strike all of subsection 6 and insert the following:

     "(6) Subsection (1) of this section does not apply if:

     (a) The partial-birth abortion is performed by a physician who reasonably believes that failure to perform the partial-birth abortion will place the life or reproductive health of the mother at risk; or

     (b) The physician performing the partial-birth abortion has been advised, by at least two physicians with specialties that would qualify them to so determine, that the fetus suffers from a defect that could reasonably be assumed will cause pre- or post-partum fetal death or will cause the fetus to have a severe post-partum disability."

EFFECT:  Redefines partial-birth abortion as a specific procedure involving termination of the life of a fetus by the introduction of an instrument or device into the cranium of a fetus that has been repositioned into a breach position and partially delivered.  Provides exceptions allowing the use of partial-birth abortions if the mother's life is at risk or if the fetus suffers from a defect likely to cause fetal death or severe post partum disability.
