     On page 1, after line 11 insert

A(5) Nothing in the section shall limit the commissioner=s authority to regulate a health care provider, a health care facility, or a provider network when the provider, facility, or network is contracting with a third party payer other than as stated in subsection (4) of this section.@

EFFECT:  Clarifies the Insurance Commissioner=s authority to regulate the provider, facility, or network when contracting with a third party payer other than carriers or federallu regulated payers.
