     (4) The scope of the commissioner=s authority to regulate payment arrangements between a health care provider, a health care facility or a provider network and a self funded third party payer governed by the federal Employer Retirement Income Security Act of 1974 (ERISA), as amended, or the federal Labor Management Relations (Taft-Hartley) Act of 1947, as amended, shall in no event exceed that permitted under federal preemption law.@

EFFECT:  Clarifies commissioner=s authority in regulating arrangements between providers/facilities and federally preempted payers.
