     Strike everything after the enacting clause and insert the following:

 

     ANEW SECTION.  Sec. 1.  The state board of education shall review school district boundary decisions involving the governing body of a city or town, with a population of less than three thousand, that includes territory located in two school districts.  The state board of education shall examine the conditions under which a portion of the city or town located in one school district should be transferred to the other school district.  The state board of education shall consider the election procedures for voters of the city, town, or school districts that are affected by the transfer; and the authority of the educational service district superintendent to alter the boundaries of school districts accordingly.  The state board of education shall provide recommendations to the house education and government administration and senate education and government operations committees by December 1, 1997.

 

     NEW SECTION.  Sec. 2. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and takes effect immediately.@


 

 

 

 

EFFECT:  Removes intent section and substantive provisions allowing the governing body of a city or town to hold a special election concerning the removal of either portion of the city or town from one school district and transfer of that portion of the city or town to the other school district.  Adds a new section that requires the state board of education to examine such transfers and provide recommendations to the legislature by December 1, 1997.  An emergency clause is provided.
