     On page 2, after line 14, insert the following:

 

     ANEW SECTION.  Sec. 2. A new section is added to chapter 9A.36 RCW to read as follows:

     (1)The Washington State Constitution gives individuals the express right to bear arms in defense of themselves and provides that right shall not be impaired.

     (2) If any individual suffers harm to his or her person or property, or any other person the individual is legally entitled to defend under RCW 9A.16.110 suffers harm to his or her person or property, as a result of complying with any legal requirement to store, leave, or secure, or attempting to avoid any potential criminal liability for not storing, leaving, or securing, a loaded firearm in a locked box, gun safe, other secure locked storage space, or with a trigger lock or other similar device that prevents the firearm from discharging, subsection (3) of this section shall apply:

     (3) The state or local government shall not be immune from a suit for civil liability for injuries or damages incurred under subsection (2) of this section.@

 

Renumber the remaining sections consecutively and correct internal references accordingly.


 

 

EFFECT:   Provides that the state or local government shall not be immune from civil liability for injuries incurred by a person as a result of the person complying with this act.
