     On page 2, line 30, after Aperformances.@ insert AThe term Atheatrical agency@ does not include any person charging an applicant a fee prior to or in advance of:

(a) Procuring employment for the applicant;

(b) Giving or providing the applicant information regarding where or from whom employment may be obtained;

(c) Allowing or requiring the applicant to participate in any instructional class, audition, or career guidance or counseling; or

(d) Allowing the applicant to be eligible for employment through the person.@

EFFECT:  Theatrical agencies will continue to be exempt from laws governing employment agencies if the agencies do not operate in the following manner: (1)Charging an applicant a fee prior to actually procuring employment, (2)providing the applicant with information on where or from whom employment may be obtained, (3) allowing the applicant to participate in classes, auditions, or career guidance or counseling, or (4) allowing the applicant to be eligible for employment through the person.
