     On page 3, line 20, after ARCW@ strike A, unless@ and insert A((, unless)) .  In addition, a local government may adopt an ordinance exempting all building permit applications from the notice of application process as long as the exempted building permit applications are determined to be consistent with the local government=s comprehensive plan and development regulations adopted pursuant to chapter 36.70A RCW. Building permit applications are not exempt under this subsection if the applicable provision of the comprehensive plan or development regulations is subject to an order of invalidity of a court or a growth management hearings board.  A notice of application shall be required under all circumstances if@

EFFECT: Allows local government to pass an ordinance exempting all building permit applications that are consistent with a local government comprehensive plan and development regulations from the SEPA notice of application process; Provides that the exemption is only permissible if the applicable section of the comprehensive plan or development regulations is not subject to an invalidity order; Provides that exemption only applies to building permit applications for which a public comment period or an open record predecision hearing is not required.
