     On page  1, beginning on line 10, strike all of section 2 and insert the following:

ANEW SECTION. Sec. 2.  A new section is added to chapter 49.12 RCW to read as follows:

     An employer may disclose to a prospective employer job-related information about a former or current employee's job performance or conduct.  An employer shall be civilly liable for the disclosure of such information only upon a showing by clear and convincing evidence that the employer knew the information was false or had a reckless disregard for the truth of the information.  Nothing in this section shall affect or limit any other state, federal, or constitutional right otherwise available.@

Correct the title accordingly.

EFFECT:  Adds that an employer will be civilly liable if he or she had a reckless disregard for the truth of the job-related information.  Clarifies that the immunity provided to an employer does not affect or limit any other state, federal, or constitutional right.
