ESHB 2830 - S AMD TO S COMM AMD (S-5237.1) - 943

    On page 11, after line 19, insert the following:

    "NEW SECTION. Sec. 8.   A new section is added to chapter 35.21 RCW to read as follows:

    No city or town may abrogate a permitted land use activity based upon a land use policy or ordinance adopted by a board or commission composed entirely of appointed officials or members who do not serve as the result of a direct election process.  Any land use permit issued for activities within the jurisdiction of such board or commission is valid until adjudicated otherwise by a court of competent jurisdiction.

    "NEW SECTION. Sec. 9.   A new section is added to chapter 36.01 RCW to read as follows:

    No county may abrogate a permitted land use activity based upon a land use policy or ordinance adopted by a board or commission composed entirely of appointed officials or members who do not serve as the result of a direct election process.  Any land use permit issued for activities within the boundaries of such board or commission is valid until adjudicated otherwise by a court of competent jurisdiction."

Renumber remaining sections and correct internal references accordingly.
