    Strike everything after the enacting clause and insert the following:

    "Sec. 1.  RCW 39.12.015 and 1965 ex.s. c 133 s 2 are each amended to read as follows:

(1) All determinations of the prevailing rate of wage shall be made by the industrial statistician of the department of labor and industries.  Except for those determinations made under subsection (3) of this section, the industrial statistician shall, by July 1, 1999, determine the prevailing rate of wage using a stratified random sampling method.

(2) In order to ensure fair and scientifically accurate prevailing wage surveys required under subsection (1) of this section, the industrial statistician shall consult with the prevailing wage advisory committee established in section 2 of this act regarding the necessary survey methods, implementation parameters, and resource allocations.

(3) Where it is determined by the industrial statistician, in consultation with the prevailing wage advisory committee established in section 2 of this act, that sample size, strata size, or other factors do not permit the effective use of a stratified random sampling method, an equally reliable statistical method shall be used.

NEW SECTION. Sec. 2.  A new section is added to chapter 39.12 RCW to read as follows:

    (1) The director shall appoint a prevailing wage advisory committee composed of twelve members:  Four members representing workers from affected industries; four members representing employers from affected industries; and four members representing public construction project owners.  A representative of the department shall serve as ex officio chair of the committee, without a vote.  Labor, business, and public owner representatives shall be appointed by the director, upon receipt of recommendations from recognized organizations, and shall include representatives from both large and small entities.

    (2) The committee shall report its activities and recommendations, as necessary, to the legislative committees dealing with commerce and labor issues.  The committee shall report to such committees regarding the implementation of RCW 39.12.015 no later than December 1, 1998.  The department shall consult with the committee on matters affecting the administration of this chapter."

    On page 1, line 2 of the title, after "wages;" strike the remainder of the title and insert "amending RCW 39.12.015; and adding a new section to chapter 39.12 RCW."

EFFECT:  Changes the composition of the advisory committee, requires the committee to report to the legislature, and requires the department to consult with the committee on administration of the chapter.
