    Beginning on page 5, line 22, strike all of section 2 and insert the following:

 

    "NEW SECTION.  Sec. 2.  A new section is added to chapter 26.44 RCW to read as follows:

    (1) When an interview of a child regarding allegations of sexual abuse is conducted by the department, that interview shall be recorded by audiotape.  Videotape may be used if it is readily available.

    (2) The department shall not make any copies of an audiotape or videotape recorded under this section.  The original tape shall be  retained by the department until its use in a personnel evaluation under section 3 of this act is concluded.  However, under any circumstance the tape must be destroyed no later than three years after the date of taping."

    EFFECT:  Reconciles section 2 with section 3 to prohibit the use of any tape other than for personnel evaluations by the department of social and health services.  Requires destruction of tape after three years.
