    Strike everything after the enacting clause and insert the following:

 

    "NEW SECTION.  Sec. 1.  The legislature finds that businesses are concerned about rules by the department of labor and industries intended to protect the public health of Washington's citizens by limiting workplace smoking.  Litigation is currently occurring over these rules.  Technological advancements might have occurred since enactment of the department of labor and industries' rules.  In order to ensure that these rules are continuing to benefit the public health of Washington's citizens as intended, the legislature finds that a review of these rules' costs, benefits, and effectiveness in light of any technological advancements is appropriate.

 

    NEW SECTION.  Sec. 2.  (1) A task force on workplace smoking shall be created, with the following members:

    (a) One member of each caucus of the senate, appointed by the president of the senate;

    (b) One member of each caucus of the house of representatives, appointed by the speaker of the house of representatives;

    (c) The secretary of health or the secretary of health's designee;

    (d) One representative of a large impacted business, appointed by the governor;

    (e) One representative of a small impacted business, appointed by the governor;

    (f) Two representatives of impacted organized labor unions, appointed by the governor;

    (g) Two representatives of consumer or public health organizations or agencies, appointed by the governor; and

    (h) Two technical experts on ventilation engineering and technology, appointed by the governor.

    (2) The task force on workplace smoking shall review the costs, benefits, and effectiveness of the department of labor and industries' rules on workplace smoking, particularly in light of any technological advancements, and shall submit recommendations to the senate and house of representatives commerce and labor committees by July 1, 1998."
