    On page 1, line 13, after "election" insert A: PROVIDED FURTHER, That nothing contained in this section shall prohibit a school district from preparing information in a good faith attempt to comply with this section and without actual malice"

    On page 1, after line 13, insert the following:

    "NEW SECTION. Sec. 2.  A new section is added to chapter 42.17 RCW to read as follows:

    All information used for school district elections shall be complete and accurate:  PROVIDED, That nothing shall prevent information being used if it is prepared in a good faith attempt to comply with this section and without actual malice."

EFFECT OF AMENDMENTS to SB 5789:  Places the duty on the school district to prepare information in good faith and without actual malice.  (The actual malice standard is the same standard used to prohibit Afalse@ advertising in political campaigns.)

    Requires all information from any source in a school district elections to be complete and accurate as long as it is prepared in a good faith attempt to comply with the requirements and without actual malice.
