    Strike everything after the enacting clause and insert the following:

    "NEW SECTION. Sec. 1.  A new section is added to chapter 19.158 RCW to read as follows:

    (1) The attorney general shall maintain a public listing, available for inspection by the public in written and electronic form, of any person that chooses not to receive commercial telephone solicitation calls at the person's residence.  The attorney general shall periodically transmit the list to the telephone preference service provided by the direct marketing association for the purpose of removing individuals from national telemarketing lists.  The attorney general and the utilities and transportation commission shall make reasonable efforts, within existing resources, to publicize the availability of the public listing and the method or methods by which people may be added to the list.

    (2) It shall be unlawful and a violation of this section for any person to place a commercial telephone solicitation call to the residence of any person who:  (a) Is listed by the attorney general pursuant to subsection (1) of this section; and (b) has been on such list for at least ten business days prior to the placing of the commercial telephone solicitation."

    On page 1, line 1 of the title, after "solicitation;" strike the remainder of the title and insert "and adding a new section to chapter 19.158 RCW."

EFFECT:  Requires the Attorney General to establish and maintain a "Do not call" list of residents who do not wish to receive commercial telephone solicitations.

    List must be available publicly in written & electronic form.

    Commercial telephone solicitations made to people on the list are unlawful and in violation of the CPA.
