Title:  An act relating to solid waste handling.

Background:  Local governments have the option of providing solid waste handling with local government employees or by contracting for solid waste handling with a public or private party.  Local governments may also enter into agreements with a public or private party to construct or operate publicly or privately owned solid waste handling systems.  Any agreement entered into must be under terms and conditions determined by the local legislative authority.

 

Summary of Bill:  Compensation to private parties for solid waste handling or landfill operations may not exceed the actual cost of operations.  The actual cost may include a reasonable return determined by the return on investment method or operating ratio method.  Determination of the compensation level is subject to judicial review under the Administrative Procedure Act.

 

Appropriation:  None.

Effective Date:  Ninety days after adjournment of session in which bill is passed.
