Background:  Upon retirement, a member may choose the standard allowance which is a retirement allowance payable throughout the member's life or the member may choose a joint and survivor option.  The joint and survivor option provides a reduced amount payable as long as either the member or beneficiary is alive.  Once selected the option may not be changed.

 

Summary of Bill:  In cases where a beneficiary violates a restraining order issued on behalf of a Public Employees Retirement System (PERS) plan 1 member, the joint and survivor option may be rescinded by the retiree, with the permission of the court.  The retiree's benefit will not increase by result of the rescission and the retiree may not select another beneficiary.

Effective Date:  Ninety days after adjournment of session in which bill is passed.
