Background: Any person convicted of a motor vehicle offense for which suspension or revocation of the driver=s license is required, other than vehicular homicide or vehicular assault, may apply for an occupational driver=s license.
Summary of Bill: Any person who has had his or her driver=s license suspended or revoked due to a conviction of driving under the influence of alcohol or drugs may not apply for an occupational driver=s license. In addition, no person whose license has been suspended or revoked may obtain a certificate of vehicle ownership, vehicle license number plates, or a certificate of license registration. A person with a suspended or revoked license may not purchase, lease, or rent a motor vehicle and no dealer or individual may knowingly sell, lease, or rent a vehicle to such an individual.
Seven years after the date of any conviction, which resulted in permanent license revocation, the person may petition for restoration of the license and it will be restored for Agood cause shown.@ Good cause is defined as sufficient evidence of permanent rehabilitation and the petitioner must demonstrate that the last seven years have been spent in a state of sobriety.
